1. Acceptance of Terms

These Terms & Conditions (“Terms”) govern your access to and use of the Nurse Diary website and services (“Service”) operated by Nurse Diary (“we”, “us”, “our”).

By creating an account, subscribing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.

These Terms are governed by the laws of New South Wales, Australia.

2. Description of Service

Nurse Diary is a personal clinical diary tool designed to help nursing and midwifery professionals keep notes and records of their clinical experiences for professional development purposes.

Important disclaimer: Nurse Diary is a personal diary tool only. It does not constitute a clinical health record, medical record, or official professional record under any legislation. You must not rely on Nurse Diary as your sole record of clinical events. Nurse Diary does not provide medical advice, clinical guidance, or professional recommendations of any kind.

3. Eligibility

To use the Service, you must:

  • Be at least 18 years of age
  • Be a current or former healthcare professional, student, or someone with a legitimate interest in clinical documentation
  • Provide accurate and complete registration information
  • Have the legal capacity to enter into a binding agreement

4. Account Registration and Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must:

  • Provide accurate, current, and complete information when registering
  • Keep your password secure and not share it with any other person
  • Set up and maintain two-factor authentication (2FA) as required by the Service
  • Notify us immediately at contact@nursediary.health if you suspect unauthorised access to your account

One account per person. You must not create accounts on behalf of others or allow others to use your account.

5. Subscription and Payment

5.1 Plans and Pricing

The Service is available on the following subscription plans (prices in AUD, inclusive of GST where applicable):

  • Monthly: $5.00 per month, billed monthly
  • Annual: $50.00 per year, billed annually

5.2 Free Trial

New subscribers receive a 14-day free trial from the date of registration. Your payment method will be charged automatically at the end of the trial period unless you cancel before the trial ends.

5.3 Billing and Auto-Renewal

Subscriptions renew automatically at the end of each billing period. Your payment method on file will be charged at the then-current subscription price. You will receive an email receipt for each charge.

Payments are processed by Stripe, Inc. We do not store your payment card details. By providing your payment details, you authorise us to charge your payment method on a recurring basis.

5.4 Cancellation

You may cancel your subscription at any time via the billing portal accessible from your account settings. Cancellation takes effect at the end of your current billing period — you will retain access to the Service until then. We do not provide partial refunds for unused portions of a billing period.

5.5 Price Changes

We may change subscription prices at any time. We will give you at least 30 days’ notice of any price increase by email. If you do not cancel before the new price takes effect, you agree to the new price.

5.6 Failed Payments

If a payment fails, Stripe will retry the charge automatically. If payment cannot be collected after a reasonable number of retries, your account will be suspended and you will lose access to the Service until the outstanding amount is paid.

6. Acceptable Use

You agree not to use the Service to:

  • Record identifiable patient information that could breach patient privacy or confidentiality obligations
  • Store information that you are legally required to retain in a certified clinical records system
  • Make clinical decisions based solely on diary entries in the Service
  • Violate any applicable law, regulation, or professional code of conduct
  • Attempt to gain unauthorised access to the Service or another user’s account
  • Upload or transmit malicious code, viruses, or harmful content
  • Impersonate any person or entity
  • Use the Service for any commercial purpose other than your own professional diary use

7. Privacy

Our collection and use of your personal information is governed by our Privacy Policy, which forms part of these Terms.

8. Intellectual Property

The Nurse Diary name, logo, software, design, and all content we create (“Our Content”) are owned by us or licensed to us. You may not reproduce, distribute, or create derivative works from Our Content without our written permission.

You own all diary content and notes that you create within the Service (“Your Content”). You grant us a limited, non-exclusive licence to store and display Your Content solely for the purpose of providing the Service to you. We claim no ownership over Your Content.

9. Data and Account Deletion

You may request deletion of your account and associated data at any time by contacting privacy@nursediary.health. Deletion is subject to our data retention obligations under applicable law (see our Privacy Policy, Section 7). Account deletion does not entitle you to a refund of any subscription fees already paid.

10. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, express or implied. To the maximum extent permitted by law, we disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or free from data loss. You are responsible for maintaining your own backups of important information.

11. Limitation of Liability

To the maximum extent permitted by law, our total liability to you for any claim arising out of or relating to the Service or these Terms is limited to the amount you paid us in the 12 months preceding the claim.

We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, or loss of professional opportunity, even if we have been advised of the possibility of such damages.

Nothing in these Terms excludes liability that cannot be excluded under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)).

12. Termination

We may suspend or terminate your account and access to the Service immediately, without notice, if:

  • You breach these Terms
  • We reasonably suspect fraudulent, abusive, or harmful activity
  • You fail to pay subscription fees when due
  • We are required to do so by law

You may terminate your account at any time by cancelling your subscription and requesting account deletion as described in Section 9.

13. Changes to These Terms

We may update these Terms at any time. If we make material changes, we will notify you by email at least 14 days before the changes take effect. Continued use of the Service after that date constitutes your acceptance of the updated Terms.

The current version of these Terms is always available at nursediary.health/terms.

14. Governing Law and Disputes

These Terms are governed by the laws of New South Wales, Australia. Any dispute arising out of these Terms or the Service will be subject to the exclusive jurisdiction of the courts of New South Wales.

We encourage you to contact us first to resolve any dispute informally before commencing legal proceedings.
